The decision, Eli Lilly v Apotex, 2023 FCA 125, was issued on June 2, 2023. The 684 patent relates to the use of oral pharmaceutical unit dosage forms containing tadalafil (2-20 mg, 2.5 mg, 5 mg, 10 mg, 20 mg, 5-20 mg) for the treatment of erectile dysfunction (ED). Lilly brought four infringement actions – against Apotex, Pharmascience/Riva, Mylan, and Teva; the defendants counterclaimed for a declaration of invalidity. In a single set of reasons, the Trial Judge found Lilly would have been entitled to relief due to infringement by each defendant if the asserted claims were valid, but held the claims were invalid for anticipation and obviousness (see our Rx IP Update report).

On the appeal, there was no issue as to the Trial Judge’s construction of the claims or factual findings. Lilly argued that the Trial Judge erred in law in her approach to construing the inventive concept in the obviousness analysis. Applying the Trial Judge’s factual findings, however, the FCA concluded that even if the new inventive concept proposed by Lilly was accepted, the finding on obviousness must stand. The prior findings – including that dose range studies would be routine steps – applied to the proposed inventive concept that “the claimed dosages of tadalafil, orally administered, provide efficacy to treat male ED, including the minimization or elimination of flushing as compared to larger doses of tadalafil”. While agreeing with the Trial Judge’s findings that drug dosing of tadalafil for the treatment of ED was routine work having regard to the prior art, the FCA declined to endorse this statement at large: “There may be cases where dosage selection is not routine.” It was unnecessary for the FCA to address the arguments on the issues of anticipation and whether the 648 patent is a selection patent. Zuellig Pharma has announced that it has completed the acquisition of two brands, Cialis (Tadalafil) and Alita (Pemetrexed), from Eli Lilly for selected ASEAN markets, including Brunei, Cambodia, Indonesia, Laos, Malaysia, Myanmar, Philippines and Thailand. The acquisition will take place via its wholly owned subsidiary, Zanovex Pte. Following the acquisition, it is intended that Zanovex will own the trademarks, marketing authorisations and licence manufacturing information for both Alimta, a chemotherapy drug for the treatment of certain types of non-small cell lung cancer and malignant pleural mesothelioma, and Cialis, a men’s health product for the treatment of erectile dysfunction. The press release explains that: ‘ZP Therapeutics, the commercial division of Zuellig Pharma, will promote the two brands in the relevant markets. Prior to the acquisition, ZP Therapeutics was responsible for the promotion and distribution of the brands as part of a broader, long-term strategic partnership with Lilly in Brunei, Indonesia, Malaysia, Philippines and Thailand’. It held a colossal 96% of the US market for impotence pills. In 2002 Viagra, the first oral drug to treat this male condition, reached $1.7 billion of global sales, of which $1.1 billion came from the US. In September 2003, Bayer and GlaxoSmithKline''s Levitra hit the impotence market. In November 2003, Cialis, co-marketed by Seattle''s Icos and Eli Lilly & Co, entered this market space. Cialis is a yellow coloured pill and Viagra, a blue one. Viagra and Levitra each had an effectiveness window in the range of 4-6 hours. Cialis expanded this window to 36 hours. Following its success in Europe, Australia and New Zealand, Cialis entered the lucrative US market in December 2003.

Condition Explanation Notes
Menusen with nitrates Risk of severe hypotension Absolute contraindication
Severe liver impairment Reduced metabolism leading to increased effects Medical consultation needed
Retinitis pigmentosa Potential risk of vision loss Use with caution
Allergic reactions Hypersensitivity to tadalafil or excipients Discontinue if occurs

The case throws light on Cialis'' strategy in the US where the pill has to contend with Levitra and the market leader, Viagra. January 22, 2015By Jessica Wilson, BioSpace.com Breaking News Staff The U.S. Food and Drug Administration (FDA) has alerted the public that counterfeit versions of the erectile dysfunction drug Cialis were found in the mail on its way to a consumer. FDA lab analysis showed the counterfeit drug contained “multiple active ingredients, which if used could result in adverse effects or harm”, the FDA said in a statement. The FDA is concerned that other shipments could exist and has posted pictures of the counterfeit package as compared to the authentic package of Cialis on the agency’s website. The counterfeit bottle includes “AUSTR81137” on the front and does not have an NDC number or the tablet strength in a colored box. The pattern is different than that of the authentic Cialis; it has yellow and a darker green design on the label. In addition, the following misspellings appear on the side of the bottle, “CLALIS is a product of: Eli Lilly Australia PTY Limited.” Further identifying features include the location as “112 Wharf Road, WEST RYDE, NSW 2114” on the side of the bottle and “Lot: AC 066018, Exp: 01SEP17” on the side of the bottle. Though an address is listed, the FDA stated the counterfeit Cialis is from an “unknown source.” The FDA stated it was not aware of any “consumer adverse events” due to the use of the counterfeit Cialis, however, the agency recommends people speak to their health care professionals if they have received a counterfeit product. People are asked to report adverse reactions to the FDA’s MedWatch Adverse Event Reporting program.
